About this notice
This shop trades as Nothing Tastes as Good as Skinny Feels. We run the website and the store behind it. That covers every product, service, tool, feature and piece of content we offer. Together we call these the "Services". Our aim is to give you, our customer, a shopping experience we have put together with care. The platform underneath is Shopify, and it is what lets us offer the Services.
This notice explains what personal information we gather, what we do with it and who we pass it to. It applies whenever you browse, buy from or otherwise use the Services. It also applies when you get in touch with us by any other route. Our Terms of Service may say something different about collecting, handling or sharing your personal information. Where they do, this notice wins.
Take time to read this notice with care. Once you access or use any part of the Services, you confirm two things. You have read it, and you understand how we treat your information as set out here.
What counts as personal information
By "personal information" we mean anything that identifies you or another individual. It also means anything that could reasonably be tied back to you or them. It excludes data gathered anonymously. It also excludes data stripped of identifiers so it can no longer point to you.
What we collect or handle turns on three things. These are how you use the Services, the place you live, and what the law allows or demands. It may fall into the groups below. We may also hold conclusions we draw from any of them.
- Ways to reach you. Your name, email, phone number and address, plus your delivery and billing addresses.
- Money and payment details. Debit card, credit card and bank or other account numbers. Also card data, account data, how you chose to pay, proof that a payment went through, the details of each transaction and any further payment details.
- Your account. Username, password, security questions, settings and preferences.
- What you shop for. Products you look at, place in your basket or save to a wishlist. Also what you buy, send back, swap or cancel, and your order history.
- Messages to us. Whatever you put in a message you send us, such as a question to our support team.
- Your device. Details of your device, your browser and your network connection. This includes your IP address and other identifiers unique to you.
- How you use the Services. Details of what you do on the Services, including when and how you move around them.
Where the information comes from
Personal information may reach us in these ways:
- From you. For example, you might open an account, browse or use the Services, or write to us. You might also hand us personal details in some other way.
- Collected automatically by the Services. This data comes from your device when you visit our sites or use what we sell. Cookies and similar tools also gather it.
- From companies that work for us. We hire them to switch on certain technology. They may also gather or handle your personal information for us.
- From partners and other outside parties.
Why we use your information
The purposes below apply to you depending on which Services you use and how you deal with us.
- Running and improving the Services, and shaping them to you. We rely on your personal information to deliver the Services and carry out our contract with you. That means taking payment and completing your orders. It also means handling purchases, returns, swaps and other transactions, and organising delivery. We use it to set up, run and look after your account, and to send you account notices. It lets us recall your preferences and the products that caught your eye. We also use it so you can leave reviews. And we use it to make your shopping personal, for example by suggesting items linked to what you bought. We may also use it to improve the Services and fit them more closely to you.
- Marketing and adverts. We use your personal information to promote what we sell. We may send you promotions, adverts and marketing by post, text or email. We may also show you online adverts on the Services or on other sites. Those adverts can reflect items you bought before, items you put in your basket and other things you did on the Services.
- Safety and stopping fraud. We use your personal information to check it really is you logging in. It helps us keep payments and shopping safe. It lets us spot, look into or act on activity that may be fraudulent, unlawful, unsafe or malicious. We also use it to keep the public safe and protect our services. If you open an account, keeping your login details safe is your job. We strongly advise you never to give your username, password or other login details to anyone.
- Keeping in touch. We use your personal information to give you customer support and to reply to you. It also helps us serve you well and keep up our working relationship with you.
- Legal grounds. We use your personal information to obey the law and to answer lawful legal process. That includes requests from the police or government bodies. We also use it to look into or take part in civil disclosure, threatened or actual court cases and other legal disputes. Finally, we use it to enforce our terms and policies and to look into possible breaches of them.
Who we pass your information to
Sometimes we give your personal information to outside parties for legitimate reasons, always under the terms of this notice. This can happen in the situations below.
- We pass it to Shopify, suppliers and others who provide services for us. Examples are IT support, taking payments, data analysis, customer service, cloud storage, order fulfilment and delivery.
- We pass it to business and marketing partners so they can run marketing and show you adverts. For example, Shopify helps us deliver adverts suited to you through outside services. These rely on what you do online across different sellers and sites. Our partners follow their own privacy notices when they use your information. Where you live may give you a right to stop us sharing your information for this purpose. That covers targeted adverts and marketing drawn from your activity across other sellers and sites.
- We pass it on when you tell us to, ask us to or agree that we can. Sending you your order is one example. Using social media widgets or signing in through another service is another.
- We pass it to our affiliates or to other members of our corporate group.
- We pass it on in connection with a business deal, such as a merger or an insolvency. We also do so to meet any legal duty that applies to us, for example answering subpoenas, search warrants and similar demands. We may also pass it on to enforce our terms of service or policies. Finally, we do so to defend and protect the Services. The same goes for our own rights and those of our users or anyone else.
How Shopify fits in
Shopify hosts the Services. To run and improve them for you, it gathers and handles personal information about how you reach and use them. Anything you enter on the Services goes to Shopify and is shared with it. It is also shared with other parties, who may be in a country other than yours. Again, the aim is to run and improve the Services for you.
We also use some advanced Shopify features to protect, grow and improve our business. These draw on data from your activity in our store, with other sellers and with Shopify itself. To offer these features, Shopify may use personal information about that activity. In these cases Shopify is in charge of handling your personal information. That includes dealing with any request you make to use your rights over it for these purposes.
The Shopify Consumer Privacy Policy explains how Shopify uses your personal information and what rights you may hold. Where you live may let you use some rights over your personal information through the Shopify Privacy Portal.
Other websites we link to
The Services may point you to sites or online platforms that other people run. We do not own or control those sites. Before you use one, check its privacy terms, security terms and any other conditions. We give no promise about how private or secure those sites are. We are not responsible for that, nor for whether their content is accurate, complete or reliable.
Some places online are public or partly public, such as outside social networks. Anything you post there may be visible to other users of the Services or of those platforms. Neither we nor anyone else is then limited in how that content can be used. A link from us does not mean, on its own, that we back that platform, its content or the people who run it. The only exception is where the Services say so.
Children
The Services are not meant for children. We do not knowingly gather personal information about anyone below the age of majority where they live. Perhaps a child in your care, as parent or guardian, has given us their details. If so, get in touch using the details at the end of this notice and ask us to erase them.
On the effective date of this notice, we have no actual knowledge of selling or sharing personal information about anyone under 16. Here "sell" and "share" carry their meaning under the relevant law.
Keeping your information safe, and for how long
No form of security is flawless or unbreakable, so we cannot promise "perfect security". Information you send us may also be exposed while it travels to us. For that reason, avoid using insecure methods to send us anything private or sensitive.
The length of time we keep your personal information varies. It turns on factors such as whether we need it to run your account or deliver the Services. Other factors are meeting our legal duties, settling disputes and enforcing our other contracts and policies.
Your rights and the choices you have
You may hold all, some or none of the rights below, depending on where you live. They are not unlimited. Some only apply in particular situations, and the law sometimes lets us turn a request down.
- Access. You may be able to ask to see the personal information we have about you.
- Erasure. You may be able to ask us to delete the personal information we keep on you.
- Correction. You may be able to ask us to put right any personal information we keep on you that is wrong.
- Portability. In some situations, and subject to some exceptions, you may be able to get a copy of your personal information. You may also be able to ask us to send it on to someone else.
- Choosing what we send you. We may email you promotions. You can stop these whenever you like with the unsubscribe link in any of our emails. We may still email you about non-promotional matters, such as your account or orders you placed.
Do you live in the UK or the European Economic Area? If so, you may also hold the rights below as well as those above. They are subject to any exceptions and limits in your local law.
- Objecting to or limiting processing. You may be able to ask us to limit or stop using your personal information for particular purposes.
- Taking back consent. Where our basis for using your personal information is your consent, you can withdraw it. Doing so does not make any earlier use based on that consent unlawful.
To use any of these rights, follow the steps shown on the Services or contact us using the details at the end of this notice. Shopify explains its own use of your personal information, and your possible rights over data it handles, at https://privacy.shopify.com/en.
Using your rights will never lead us to treat you unfairly. We may have to confirm who you are before we act on a request, where the law allows or requires this. The law also lets you appoint an authorised agent to make requests for you. If an agent contacts us, we will ask for proof that you gave them that authority. We may also ask you to confirm your identity with us yourself. We will reply within the time the law requires.
Raising a complaint
Unhappy with how we handle your personal information? Contact us using the details at the end of this notice. Where you live may give you a right to challenge our decision. You can do that by contacting us through those same details. You may also be able to complain to your local data protection authority. In the EEA, the supervisory authorities are listed on the European Data Protection Board website.
Sending information abroad
Your personal information may be moved to, kept in or handled in a country other than yours.
Sometimes we move it outside the UK or the European Economic Area. When that happens, we use an accepted safeguard. One example is the Standard Contractual Clauses from the European Commission. Another is a matching contract issued by the competent UK authority, where that applies. We do not need these safeguards when the destination country has been found to protect data adequately.
When this notice changes
We may revise this notice now and then. That could be to reflect how our practices change, or for operational, legal or regulatory reasons. When we do, we will publish the new version on this website. We will also change the date at the top and give you any notice the law requires.
How to reach us
You may want to ask about this notice or how we handle privacy. You may also want to use any of your rights. Either way, email us at jayneandmartinuw@gmail.com.
For the purposes of the relevant data protection laws, your personal information is controlled by us as data controller.
