Terms of service
Terms of Service
These terms set out the agreement between you and our shop. Please take time to read them. They explain your legal rights. They also limit what we accept responsibility for and exclude certain warranties.
About us and this agreement
Nothing Tastes as Good as Skinny Feels is the trading name of this shop. It is run by Jayne Gray, Independent Herbalife Member. Where these terms say "we", "us" or "our", they mean Nothing Tastes as Good as Skinny Feels.
We run this online shop and website. That covers the content, information, tools, features, products and services we make available to you as a shopper. Together we call all of this the "Services". We aim to offer you a selected range of goods.
Our shop runs on the Shopify platform. Shopify's technology is what lets us offer the Services to you.
In this document, "Terms" means these terms and conditions plus any policy they refer to. The Terms describe what you may expect from us and what we expect from you.
You accept the Terms, and our Privacy Policy, as soon as you visit, use or interact with the Services. If you are not willing to accept them, please stay off the Services.
Who can use the shop
By accepting the Terms, you confirm you have reached the legal age of adulthood where you live. You also confirm that any children who depend on you may use the Services on devices you own, buy or look after, with your permission.
We may ask for some details before you browse, visit our shops or buy from us. These can include your email address and your billing, payment and delivery details. You promise that everything you give us is true, up to date and complete. You also promise you have the right to share it.
Your account
Keeping your login details safe is your job alone. You are answerable for everything that happens on your account. You cannot sell, pass on, assign or license your account to anybody else.
Our products
We have tried hard to show our goods and services accurately. Even so, colours and appearance can look different on your screen. This depends on the device you use and how it is set up.
We give no promise that what you buy will look the same as our images or match your hopes for its quality.
We may change any product description whenever we choose, without telling you first. We may stop selling any product at any time. We may also restrict how much of a product we sell to a person, region or jurisdiction. We decide this case by case.
Placing an order
An order from you is an offer to buy. We are free to accept or refuse it for any reason we choose. No contract exists until we confirm we have accepted your order. We also need to receive and process your payment before we accept.
Check your order with care before you send it. Once we accept an order, we may not be able to cancel it for you.
If we refuse, alter or cancel an order, we will try to let you know. We will use the email address, billing address or phone number you gave when ordering.
You confirm that you are buying for yourself or your household. You are not buying to resell as a business or to export.
Returns and exchanges
Returns and exchanges are handled only under the rules in our Refund Policy.
Prices, promotions and payment
We can change prices, discounts and promotions without warning. You pay the price that applied when you placed your order. Your order confirmation email will show that price.
Unless we clearly say otherwise, listed prices leave out tax, postage, handling, customs duty and import fees.
Our online prices may not match those in physical shops. They may also differ from prices in online or other shops that third parties run.
Now and then we may run promotions through the Services. These can change prices and come with their own separate conditions. Where those conditions clash with the Terms, the promotion's conditions take priority.
For every purchase, you agree to give us accurate, full and current details about the purchase, your payment and your account. You also agree to update your details quickly when they change. That includes your email address, card numbers and card expiry dates. We need this to finish your orders and to reach you when necessary.
You make these promises about payment:
- the card details you give are accurate, true and complete;
- you have proper authority to use that card for the purchase;
- your card provider will pay the charges you run up; and
- you will pay those charges at the listed prices, with postage, handling and any tax that applies.
Delivery
We accept no liability when a delivery arrives late. Any delivery time we give is a guide, not a promise. Delays caused by couriers, customs checks or events beyond our control are not our responsibility.
When we hand your goods to the courier, ownership passes to you. So does the risk of the goods being lost or damaged.
Errors on the site
From time to time the Services may contain mistakes, gaps or typing errors. These might affect product descriptions, prices, offers, promotions, postage charges, delivery times or stock levels.
We may fix any such mistake at any time. We may also change or update information, or cancel orders where information was wrong. We can do this without telling you first, even after you have ordered.
Content we own
We, our affiliates or our licensors own the Services and what they contain. This includes trade marks, brands, text, displays, pictures, graphics, product reviews, video and audio. It also includes how all of that is designed, chosen and arranged. Patent, copyright and other intellectual property laws in the United States and other countries protect it.
You may use the Services only for your own private purposes, never for business. Without our written consent in advance, you must not copy, share, alter, adapt, display or perform in public, republish, download, store or send any material from the Services.
The Terms give you no licence or other right under any patent, trade mark, copyright or other intellectual property. That applies whether it belongs to us, to Shopify or to anyone else, unless the Terms plainly say so. Using the Services without permission could break intellectual property law. We keep every right that the Terms do not clearly give to you.
Trade marks
Our names, logos, slogans, designs and product and service names are trade marks of Nothing Tastes as Good as Skinny Feels, its affiliates or its licensors. You need our written permission before using them.
Shopify's name, logo, slogans, designs and product and service names belong to Shopify as its trade marks. Any other names, logos, slogans, designs or product and service names on the Services are trade marks of whoever owns them.
Reviews, ideas and other things you send us
You might send us ideas, suggestions, reviews, proposals, plans, comments or other material. It makes no difference whether you upload, post or email it. We call all of this "Feedback".
By sending Feedback, you give us a licence to use it. The licence has no end date, covers the whole world, is free of any royalty and can be sublicensed. Under it we may copy, change, publish, distribute and display your Feedback in any format and for any reason, including commercial ones. For instance, we may use it to run, supply, assess, develop and market the Services, and to carry out our duties and use our rights under the Terms.
You also confirm three things. First, you own your Feedback or hold every right needed to share it. Second, you have told us about any payment or reward you received for giving it. Third, your Feedback follows the Terms.
We have no duty to keep your Feedback private. We have no duty to pay you for it. We have no duty to reply to it.
We may choose to check, edit or delete Feedback, though we are not bound to. We may do so where we decide it is illegal, offensive, threatening, libellous, defamatory, pornographic, obscene or otherwise unacceptable. The same applies where it breaks the Terms or anyone's intellectual property rights.
Rules for Feedback
Your Feedback must not break anybody's rights. That covers copyright, trade marks, privacy, personality rights and any other personal or ownership rights.
It must not be libellous, abusive, obscene or otherwise against the law. It must not carry viruses or other malware that could harm the Services or any linked website.
Do not give a fake email address or pose as someone else. Do not mislead us or anyone else about where Feedback came from.
You alone are answerable for your Feedback and whether it is accurate. We take on no responsibility or liability for Feedback that you or anyone else posts.
What you must not do
Use the Services only for legal purposes. Neither directly nor through someone else may you use them:
- for anything illegal or harmful;
- to break any law, rule or regulation, whether local, national or international;
- to infringe our intellectual property or that of anyone else;
- to harass, abuse, insult, threaten, defame, slander, belittle or harm our staff or any other person;
- to send information that is untrue or misleading;
- to send, receive knowingly, upload, download or reuse material that breaks the Terms;
- to send, or arrange for others to send, unwanted adverts or marketing, such as spam, junk mail or chain letters;
- to pose, or try to pose, as another person or organisation; or
- for anything else that limits other people's use or enjoyment of the Services, or that we judge could harm or create liability for us, Shopify or other users.
You also must not:
- upload or send viruses or other harmful code that could affect how the Services work;
- copy, duplicate, extract, sell, resell or exploit any part of the Services;
- gather or track other people's personal information;
- spam, phish, pharm or pretext the Services;
- reach the Services with robots, spiders, scrapers, data harvesting or extraction tools, automated devices or processes, or AI tools (agentic AI included), or by any other means, automated or manual; or
- get around, interfere with or bypass our security or authorisation features, robot exclusion headers or other access controls.
If we decide you have broken any part of the Terms, we may suspend, disable or close your account whenever we like and without warning.
Automated agents
This part applies when you use, permit, switch on or set up an Agent that accesses, uses or interacts with the Services.
An "Agent" is software or a service that acts fully or partly on its own for a person or organisation, or on their instructions. It can run for someone, or on their device, with nobody directly supervising it.
An Agent may only access, use or interact with the Services if it names itself and keeps to every rule below at all times. An Agent must stay away from the Services entirely if we have asked it not to use any service.
We may restrict whether and how any Agent reaches, uses or interacts with the Services. We may use technical measures to do this.
Every Agent must:
- state in each HTTP or HTTPS request that it comes from an Agent, and give the Agent's name by putting "Agent/[agent name]" in the user agent string;
- never hide or disguise that it is an Agent, for example by copying the way people behave and interact, or by solving or getting around CAPTCHAs or other checks that tell people from computers apart;
- answer honestly any question or prompt asking whether a person or a computer is behind the activity; and
- never dodge or get around any measure meant to block, limit, change or control how Agents use the Services.
Third-party tools and websites
Optional tools
As part of the Services, you may be able to use shopper tools that outside companies provide. We do not watch over these tools and have no say in or control over them.
You accept that we offer these tools "as is" and "as available". We give no warranty, representation, condition or endorsement of any kind about them. We have no liability of any sort connected with your use of them.
Using them is your own choice and at your own risk. Make sure you know and are content with the provider's terms for each tool.
We may add new features, tools or resources to the Services later. The Terms will cover those too, as they form part of the Services.
Links and content from others
The Services may include material from third parties, including functions built into our pages, and links to sites they own or run. We do not check or assess whether that material or those sites are accurate or suitable. If you follow a link away from the Services, the risk is yours.
We are not liable for harm or loss connected with your visits to other websites. Nor are we liable for any goods, services, resources or content you buy or use there.
Read the third party's policies and practices closely before you deal with them. Send any complaint, claim, concern or question about their goods or services to that third party.
Shopify's role
Shopify provides the platform that lets us offer the Services. Even so, when you buy from our shop, your contract is directly with Nothing Tastes as Good as Skinny Feels.
When you use the Services, you accept that Shopify bears no responsibility for any part of a sale between you and us. That includes any injury, loss or damage caused by goods or services you buy.
You expressly release Shopify and its affiliates from every claim, loss and liability connected with your purchases and dealings with Nothing Tastes as Good as Skinny Feels.
Your personal information
Our Privacy Policy governs all personal information we gather through the Services. Some personal information may also fall under Shopify's Privacy Policy. By using the Services, you confirm you have read both policies.
Shopify hosts the Services. For that reason, Shopify gathers and handles personal information about how you reach and use them. It does this to run and improve the Services for you.
What you submit through the Services goes to Shopify and is shared with it. It is also shared with third parties, some of whom may be based outside your home country, so that services can be provided to you. Our Privacy Policy gives fuller detail on the ways your personal data is used by us, by Shopify and by our partners.
No warranties
Information on or through the Services is for general guidance only. We make no promise that it is accurate, complete or useful. If you rely on it, you do so entirely at your own risk. We accept no liability or responsibility for reliance on it by you, by any other visitor or by anyone told about it.
Unless Nothing Tastes as Good as Skinny Feels expressly says otherwise, you receive the Services and every product sold through them "as is" and "as available". We give no representation, warranty or condition of any kind, express or implied. This excludes every implied warranty or condition as to durability, title, merchantability, satisfactory quality, non-infringement and fitness for a particular purpose.
We do not promise that the Services will always be available, on time, secure or free from errors.
The law in some places restricts or forbids excluding implied warranties. In the UK, the Consumer Rights Act 2015 is one such law. Where a law like this applies to you, the exclusions in this section may not apply.
Limits on our liability
This section applies as far as the law allows.
It protects Nothing Tastes as Good as Skinny Feels and our partners, directors, officers, staff, affiliates, agents, contractors, service providers and licensors. It protects those of Shopify and its affiliates in the same way.
None of them will be liable for injury, loss or claims of any kind. This covers direct, indirect, incidental, punitive, special and consequential damages. Examples include lost profits, revenue or savings, lost data, the cost of replacements and similar losses.
The exclusion applies whatever the legal basis. It covers contract, tort (negligence included), strict liability and every other ground.
It covers claims that arise from your use of the Services or of any goods obtained through them. It also covers any other claim connected in any way with a product or with your use of the Services. That includes mistakes or gaps in content, and loss or damage caused by using the Services or anything posted, sent or offered through them. It applies even if someone warned of the chance of such loss.
Your promise to cover our losses
You agree to indemnify and defend the people listed below and to hold them harmless. They are Nothing Tastes as Good as Skinny Feels and Shopify, plus our affiliates, partners, officers, directors, staff, agents, contractors, licensors and service providers.
This covers losses, damages, liabilities and claims owed to any third party, including reasonable legal fees. It applies where these arise from:
- you breaking the Terms or any document they include by reference;
- you breaking a law or another person's rights; or
- you accessing or using the Services.
We will tell you about any claim this covers. If we are slow to tell you, your duties still stand, unless the delay has seriously harmed your position.
We may take charge of defending and settling the claim at your cost, and choose the lawyers. We will not settle on terms that place non-financial duties on you unless you agree. You must not refuse that agreement unreasonably.
You will help with the defence of any covered claim, for example by handing over relevant documents.
Ending the agreement
We may end this agreement, or your use of all or part of the Services, whenever we decide. We do not need to give notice. You still owe everything due up to and on the day it ends.
Some parts of the Terms carry on after the agreement ends. These are the parts on content we own, Feedback, ending the agreement, warranties, liability, indemnity, severability, waiver and the whole agreement, assignment, governing law and personal information. Any other part that by its nature ought to continue does so too.
Legal points
If part of the Terms is invalid
A court or authority may find part of the Terms unlawful, void or unenforceable. If so, that part still applies as far as the law permits. Whatever cannot be enforced is treated as cut out. The rest of the Terms stays valid and enforceable.
Waiver and the whole agreement
If we do not use or enforce a right or term, we have not given it up.
The Terms, together with any policies or operating rules we publish on this site or about the Services, form the full agreement between us. They govern how you use the Services. They replace any earlier or parallel agreement, message or proposal between us, spoken or written. That includes older versions of the Terms.
Where the wording of the Terms is unclear, it will not be read against us for having written it.
Transferring the agreement
You need our written permission in advance to transfer, assign or delegate this agreement, or any right or duty you hold under it. Any attempt without that permission has no effect. We may transfer, assign or delegate the Terms and our rights and duties without your consent and without telling you.
Governing law
The Terms, and any separate agreement under which we supply Services to you, are governed and interpreted according to the law of England and Wales. You and we both accept that the courts of England and Wales are the right place for any case, and that they have jurisdiction over us.
Headings
Headings are here to help you find your way. They do not limit or change the meaning of the Terms.
Updates to these terms
This page always shows the latest version of the Terms.
We may update, alter or replace any part of the Terms at our discretion. We do this by posting the changes on our website. Please check the website regularly for updates.
Where a change is significant, we will tell you as the law requires. The change takes effect from the date given in that notice.
If you keep using or accessing the Services after we post a change, you accept that change.
